Distance Sales Contract

1. THE PARTIES

This Contract has been signed between the following parties in accordance with the terms and conditions set forth below.

By accepting this Contract, the BUYER preemptively agrees that if they confirm the order subject to this Contract, they will be obligated to pay the order amount as well as any additional fees (such as shipping charges and taxes) specified, and acknowledges that they have been duly informed about these charges.

2. DEFINITIONS

In the application and interpretation of this Contract, the following terms shall have the meanings indicated below:

• MINISTER: the Minister of Customs and Trade,
• MINISTRY: the Ministry of Customs and Trade,
• LAW: the Law on the Protection of Consumers numbered 6502,
• REGULATION: the Distance Contracts Regulation,
• SERVICE: any consumer transaction (other than the provision of goods) performed or promised in exchange for a fee or benefit,
• SELLER: the company that offers goods to the consumer within its commercial or professional activities or acts on behalf of or in the account of the provider of goods,
• BUYER: the natural or legal person who acquires, uses, or benefits from a good or service for purposes other than commercial or professional ones,
• SITE: the website belonging to the SELLER,
• ORDERER: the natural or legal person who orders a good or service through the SELLER’s website,
• THE PARTIES: the SELLER and the BUYER,
• CONTRACT: this contract entered into between the SELLER and the BUYER,
• GOOD: the movable item subject to the transaction and the software, audio, video, and similar intangible goods prepared for use in electronic media,

3. SUBJECT

This Contract regulates the rights and obligations of the parties, in accordance with the provisions of the Law on the Protection of Consumers numbered 6502 and the Distance Contracts Regulation, regarding the sale and delivery of the product—whose characteristics and sale price are specified below—that the BUYER orders electronically through the SELLER’s website.

The prices listed and advertised on the site are the sale prices. The advertised prices and promises remain valid until updated or changed. Prices advertised for a limited time remain valid until the end of the specified period.

7. INFORMATION ABOUT THE PRODUCT(S) SUBJECT TO THE CONTRACT

7.1. The basic characteristics (type, quantity, brand/model, color, number) of the good/product/service are published on the SELLER’s website. If the SELLER has organized a campaign, you may review the basic characteristics of the product during the campaign period. These characteristics are valid until the end of the campaign.

7.2. Prices

The prices listed and advertised on the site are the sale prices. The advertised prices and promises remain valid until they are updated or changed. Prices advertised for a limited time remain valid until the end of the specified period.

7.3. Taxes and Payments

The sale price, including all applicable taxes, of the good or service subject to this Contract has been communicated to the BUYER.

9. GENERAL PROVISIONS

9.1. Information and Acceptance

The BUYER acknowledges, declares, and undertakes that they have read and understood the basic characteristics, sale price, payment method, and preliminary delivery information of the product as provided on the SELLER’s website, and have given the necessary electronic confirmation.

9.2. Delivery Period

Each product subject to this Contract will be delivered within the period specified in the preliminary information on the website, depending on the distance to the BUYER’s place of residence, provided that it does not exceed the legal period of 30 days.

10. RIGHT OF WITHDRAWAL

In the case of the contract concerning the sale of goods under distance selling, the BUYER may exercise the right of withdrawal without providing any reason by notifying the SELLER within 14 days from the delivery date of the product to either themselves or the person/organization at the indicated address.

11. PRODUCTS EXCLUDED FROM THE RIGHT OF WITHDRAWAL

Products prepared at the explicit request or clearly for the personal needs of the BUYER—such as underwear, makeup, and disposable products—are excluded from the right of withdrawal.

12. DEFAULT AND ITS LEGAL CONSEQUENCES

The BUYER acknowledges, declares, and undertakes that if they default in making payments by credit card, they will be liable to pay interest under the credit card agreement with the card-issuing bank and will be responsible to the bank.

13. COMPETENT COURT

Any complaints or objections arising from this Contract shall be submitted to the consumer arbitration board or consumer court in the location where the consumer resides or where the consumer transaction took place.

14. EFFECTIVENESS

When the BUYER makes the payment for the order placed through the Site, they are deemed to have accepted all the terms of this Contract.
